These Terms and Conditions ("Terms") govern access to and use of Rush ("Rush", "the platform", "the service"), offered by Rush Systems, Inc., a company incorporated in the State of Delaware, USA ("Rush", "we", "us"). By accessing or using the platform you accept these Terms. If you do not agree, do not use the service.

1. Purpose

These Terms govern the relationship between Rush Systems and the individuals or businesses that access the Rush platform, a software tool to organize and understand business operations.

Rush helps businesses bring together their operational information (sales, inventory, cash, costs, and customers), understand the state of their business, and receive recommendations on what to address. Rush is not a financial, accounting, tax, or legal advisory service; its indicators and recommendations are informational.

Sign-in is done with your phone number and a one-time code (OTP) sent via WhatsApp. You are responsible for maintaining control of your line and of the activity carried out under your account, as well as for the accuracy of the information you record. Notify us immediately of any unauthorized use.

You agree not to use Rush for unlawful purposes and, in particular, not to:

Use of Rush is currently free of charge unless stated otherwise. In the future Rush may offer paid plans; any pricing, billing, or renewal terms will be communicated in advance before they apply to your account.

8. Your data and your business's data

The content you upload is yours. You grant us a limited license to process it solely to provide you the service, in accordance with our Privacy Policy. We do not sell your data.

9. Availability and warranties

Rush is offered "as is" and "as available." As an actively developed product, it may contain errors, interruptions, or changes, and we do not guarantee continuous availability or absolute accuracy of calculations. We will try to notify you of relevant maintenance or changes when possible.

10. Intellectual property

The platform, its brand, design, and software are the property of Rush Systems. These Terms do not transfer any rights to that intellectual property to you. You retain ownership of the content you upload.

11. Limitation of liability

To the extent permitted by law, Rush will not be liable for indirect damages, lost profits, or data loss arising from the use or inability to use the service. Business decisions you make based on the information displayed are your sole responsibility.

12. Changes and termination

We may update these Terms and the service. If changes are material, we will try to notify you, and the current version will be published on this page. We may suspend or terminate access for breach of these Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms will be submitted to the competent courts under that law.
