Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of Rush ("Rush", "the platform", "the service"), offered by Rush Systems, C.A. ("Rush", "we"), a Venezuelan company. By accessing or using the platform you accept these Terms. If you do not agree, do not use the service.

1. Purpose

These Terms govern the relationship between Rush Systems and the people or businesses that access the Rush platform, a software tool for organizing and understanding how a business runs. They also govern use of the somosrush.io website and sign-up to the early access list, which today is the only thing you can do here.

3. Description of the service

Rush helps businesses bring together their operating information (sales, inventory, cash, costs, purchases and customers), understand the state of their business and receive recommendations on what to attend to. Some of those recommendations are generated automatically from your data, including the answers from the AI advisor.

Rush is not a financial, accounting, tax or legal advisory service. Its indicators and recommendations are guidance and do not replace your accountant. You make the decisions.

4. Who can use Rush

Rush is a work tool for businesses. To use it or join the list you must be 18 or older and act on behalf of a business you can make decisions for. If you sign up for a company, you confirm you are authorized to do so.

Joining the list is free and commits you to nothing: it is not a contract, it does not reserve a payment and it does not commit you to using Rush afterwards.

Sign-in happens with your phone number and a one-time code (OTP) sent via WhatsApp. You are responsible for keeping control of your line and for the activity carried out under your account, as well as for the accuracy of the information you record. Notify us immediately of any unauthorized use.

Using Rush is free for now, unless stated otherwise. In future Rush may offer paid plans; any price, billing or renewal condition will be communicated in advance before it applies to your account, and you will then decide whether to continue.

10. Your data and your business data

The content you load is yours. You grant us a limited license to process it for the sole purpose of providing you the service, in accordance with our Privacy Policy. We do not sell your data.

You can take it with you. If you close your account, we keep your information for 90 days so you can export it, and then we delete it. You can also request a copy while the account is active by writing to us.

We write to you for two different reasons, and they are separable:

12. Availability and warranties

Rush is provided "as is" and "as available". As a product under active development, it may contain errors, interruptions or changes, and we do not guarantee continuous availability or absolute accuracy of calculations. We will try to give notice of maintenance or relevant changes where possible.

Force majeure. We are not liable for failures caused by things outside our control: power or internet outages, failures of the providers Rush depends on, natural disasters or decisions by an authority. If something like that happens we tell you, and we fix it as soon as we can.

If we ever stopped operating the service, we would give you reasonable advance notice and a way to export your information before shutting it down.

13. Intellectual property

The platform, its brand, design and software are the property of Rush Systems. These Terms do not transfer any right over that intellectual property to you. You retain ownership of the content you load.

14. Limitation of liability

To the extent permitted by law, Rush will not be liable for indirect damages, loss of profit or loss of data arising from the use of or inability to use the service. The business decisions you make based on the information shown are your sole responsibility.

15. Changes and termination

We may update these Terms and the service. If the changes are relevant, we will try to notify you through the channel you gave us, and the current version will be published on this page with its date. We may suspend or terminate access for breach of these Terms. You can stop using Rush and close your account whenever you like.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Bolivarian Republic of Venezuela. Any dispute arising from these Terms will be submitted to the competent courts of the city of Maracaibo, Zulia state.

Nothing above removes the rights that the law of your country grants you on a mandatory basis.
